ARTICLE 1 - Scope of application
These General Conditions of Sale apply, without restriction or reservation, to all sales concluded by Walid (“the Seller”) to consumers and non-professional buyers (“The Customers or the Customer”), wishing acquire the products offered for sale by the Seller (“The Products”) on the ledupstore.com website.
They specify in particular the conditions of ordering, payment, delivery and management of possible returns of Products ordered by Customers.
These General Conditions of Sale may be supplemented by special conditions, set out on the website, before any transaction with the Customer.
These General Conditions of Sale apply to the exclusion of all other conditions, and in particular those applicable to sales in stores or through other distribution and marketing channels.

ARTICLE 5 - Orders
5-1. Placing the order
It is up to the Customer to select the Products he wishes to order on the ledupstore.com website, according to the following terms:

ARTICLE 6 - Prices
The Products are supplied at the current prices appearing on the ledupstore.com website, when the order is registered by the Seller.
Prices are expressed in euros, excluding tax and including tax.
The prices take into account any reductions that may be granted by the Seller on the ledupstore.com website.
These prices are firm and cannot be revised during their period of validity, as indicated on the website ledupstore.com, the Seller reserving the right, outside this period of validity, to modify the prices at any time.
The prices do not include processing, shipping, transport and delivery costs, which are invoiced additionally, under the conditions indicated on the ledupstore.com website and calculated before placing the order.
The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.
An invoice is established by the Seller and given to the Customer upon delivery of the Products ordered.
ARTICLE 7 - Payment conditions
The price is payable in cash, in full on the day the order is placed by the Customer, according to the following terms:

- By bank check
- Wire Transfer
The Customer guarantees to the Seller that he has the authorizations possibly necessary to use the payment method chosen by him, when validating the order form.
The Seller reserves the right to suspend any order management and any delivery in the event of refusal of authorization for payment by credit card from officially accredited organizations or in the event of non-payment.
The Seller reserves the right in particular to refuse to make a delivery or to honor an order from a Customer who has not fully or partially paid a previous order or with whom a payment dispute is being administered. .
The Seller has implemented an order verification procedure intended to ensure that no person uses the bank details of another person without their knowledge.
As part of this verification, the Customer may be asked to send a copy of an identity document and proof of address to the Seller by fax. The order will then only be validated after receipt and verification by the Seller of the parts sent.
The Seller reserves the right to cancel any order that it deems non-compliant.
ARTICLE 8 - Deliveries
The Products ordered by the Customer will be delivered in mainland France, Belgium and Luxembourg, to the address indicated by the Customer when ordering on the ledupstore.com website.
The Customer is required to check the condition of the Products delivered. He has 14 days from delivery to formulate his reservations, complaints or refusals in writing, with all relevant supporting documents, to the Seller.
After this period and failing to have complied with these formalities, the Products will be deemed to be compliant and free from any apparent defect and no complaint can be validly accepted by the Seller.
The Seller will reimburse or replace, at its choice and at its expense, the Products delivered whose lack of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions provided for in articles L. 217-4 et seq. Consumer Code and those provided for in these General Conditions of Sale.
The transfer of risk of loss and deterioration of the Products to the Customer will be made after full payment of the price by the latter, upon receipt of the Products by the Customer.
ARTICLE 9 - Right of withdrawal
In accordance with the legal provisions in force, the Customer has a period of 14 days from receipt of the Products to exercise his right of withdrawal from the Seller, without having to provide reasons or pay a penalty, for the purpose of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within 14 days following notification to the Seller of the Customer's decision to withdraw.
Returns must be made in their original condition and complete (packaging, accessories, instructions) allowing them to be remarketed in new condition, accompanied by the purchase invoice.
Return costs are the responsibility of the Customer.
ARTICLE 10 - Responsibility of the Seller - Guarantee
The Products supplied by the Seller benefit automatically and without additional payment, independently of the right of withdrawal, in accordance with legal provisions:
- the legal guarantee of conformity, for Products that are apparently defective, damaged or damaged or do not correspond to the order,
- the legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the products delivered and rendering them unfit for use,
- under the conditions and according to the terms defined in the appendix to these General Conditions of Sale (Guarantee of Conformity / Guarantee of Hidden Defects).
Please note that as part of the legal guarantee of conformity, the Customer benefits from a period of two years from delivery of the goods to take action against the Seller. He can choose between repairing or replacing the good, subject to the cost conditions provided for by article L. 217-9 of the Consumer Code.
He is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods. This deadline is extended to twenty-four
months from 01/28/2023 due to product specificities.

The legal guarantee of conformity applies independently of any commercial guarantee which may possibly cover the Product. The Customer may also decide to implement the guarantee against hidden defects in the Product in accordance with article 1641 of the Civil Code. In this case, he can choose between canceling the sale or reducing the sale price in accordance with article 1644 of the Civil Code.
If the right of withdrawal is exercised within the aforementioned period, only the price of the Product(s) purchased and the delivery costs are refunded; return costs remain the responsibility of the Customer. Reimbursement occurs within fourteen days from notification to the Seller of the withdrawal decision.
ARTICLE 12 - Protection of personal data
In application of law 78-17 of January 6, 1978 amended by law n°2018-493 of June 20, 2018, it is recalled that the personal data requested from the Customer are necessary for the processing of their order and the preparation of invoices. , notably. This data may be communicated to any partners of the Seller responsible for the execution, processing, management and payment of orders.
The processing of information communicated via the ledupstore.com website meets legal requirements regarding the protection of personal data, the information system used ensuring optimal protection of this data.
The Customer has, in accordance with the national and European regulations in force, a right of permanent access, modification, rectification, opposition to portability and limitation of processing with regard to information concerning him. ARTICLE 13 - Intellectual property

ARTICLE 14 – Unpredictability
These General Terms and Conditions expressly exclude the legal regime of unforeseen circumstances provided for in Article 1195 of the Civil Code for all sales operations of Products from the Seller to the Customer. The Seller and the Customer therefore each waive the right to avail themselves of the provisions of Article 1195 of the Civil Code and the contingency regime provided for therein, undertaking to assume their obligations even if the contractual balance is upset by circumstances which were unforeseeable at the conclusion of the sale, even if their execution proved excessively onerous, and to bear all the economic and financial consequences.
ARTICLE 15 - Force majeure
The Parties cannot be held responsible if the non-performance or delay in the performance of any of their obligations, as described herein, results from a case of force majeure, within the meaning of the article 1218 of the Civil Code.
ARTICLE 16 - Applicable law - Language
These General Conditions of Sale and the operations resulting from them are governed by French law. They are written in French. In the event that they are translated into one or more languages, only the French text will be authentic in the event of a dispute.
ARTICLE 17 - Disputes
All disputes to which the purchase and sale operations concluded in application of these general conditions of sale could give rise, concerning their validity, their interpretation, their execution, their termination, their consequences and their consequences and which could not have been be resolved between the seller and the customer will be submitted to the competent courts under the conditions of common law.
The Customer is informed that he can in any case resort to conventional mediation, in particular with the Consumer Mediation Commission (Consom. C. art. L 612-1) or with existing sectoral mediation bodies or to any alternative method of dispute resolution (conciliation, for example) in the event of a dispute.
ARTICLE 18 - Pre-contractual information - Customer acceptance
The fact of a natural (or legal) person ordering on the ledupstore.com website implies full and complete adherence and acceptance of these General Conditions of Sale and obligation to pay for the Products ordered, which is expressly recognized by the Customer, who waives, in particular, the right to rely on any contradictory document, which would be unenforceable against the Seller.
